The leader “Malady Front” was accused of violation of “political” article of the Criminal Code - Article 193 of the Criminal Code of the Republic of Belarus (“Activity on behalf of an unregistered organization”). The Article was added to the Criminal Code in December 2005 as part of a series of amendments that introduced penalties for civil society organizations and other outspoken critics of the government, in the lead-up to the presidential elections in March 2006. Zmitser Dashkevich was sentenced on 1 November 2006 to 1.5 years' imprisonment for 'organizing or participating in an activity of an unregistered non-governmental organization'.
The trial and the court decision were condemned as politically motivated by the national and international democratic communities. Despite the national and international protests that urge the Belarusian authorities to release Zmitser Dashkevich, he is held in prison. The Amnesty International considers him as a prisoner of conscience, imprisoned solely for the peaceful exercise of his rights to freedom of assembly, association and expression. Zmitser Dashkevich serves his sentence in Shklou colony with a strict regime. He does forced work at a saw mill. His health has worsened because of hard working conditions and improper medical treatement.
Zmitser Dashkevich has already been a prisoner of conscience following his arrest in April this year during a demonstration to mark the 20th anniversary of the Chernobyl nuclear disaster. At that time he was sentenced, under the Belarusian Administrative Code, to 14 days’ imprisonment for "organizing an unsanctioned meeting". He was released having served his full sentence.
On 14 of August 2007, another criminal case against Zmitser Dashkevich was opened after his refusal to provide testimonial evidence against other members of Malady Front, in particular the young activist Ivan Shyla, who is accused of “activity on behalf of an unregistered organization”. He was indicted of refusal to attest, Article 402 of the Criminal Code of the Republic of Belarus. He was sentensed to fine .
